Case file: Port Arthur and firearms law reform

On 28 April 1996, a mass shooting at Port Arthur in Tasmania killed 35 people and injured many others. The event led to intense public debate about firearm access and community safety. The Commonwealth Government, led by Prime Minister John Howard, and state and territory governments negotiated a coordinated response. In May 1996, the Australasian Police Ministers’ Council agreed to the National Firearms Agreement (NFA). The agreement set national principles, including tighter controls on firearm categories, licensing and registration requirements, and a buyback of certain firearms. Because firearms regulation largely depended on state and territory laws, those governments passed legislation to put the agreed measures into effect. The Commonwealth helped fund the buyback through a temporary levy. Implementation involved practical and political challenges, including coordinating different jurisdictions, collecting firearms, and balancing public safety with firearm owners’ interests and rights. The NFA is an example of cooperative federalism: governments with different responsibilities negotiated a shared policy response. It did not make every detail of firearm law identical across Australia.
